Terms of Service

1. Acceptance of Terms

By accessing or using HullKeeper (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use constitutes acceptance of any changes.

2. Description of Service

HullKeeper is a boat maintenance tracking application that helps boat owners manage maintenance schedules, log service history, and store boat-related documents. The Service includes web and mobile applications and related backend services.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You may register using an email address and password, or through a supported third-party authentication provider (Google, Apple). You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use of your account

You must be at least 13 years of age to create an account.

4. Your Data

You retain ownership of all data you submit to the Service, including boat specifications, maintenance records, and uploaded documents ("Your Data"). By using the Service, you grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Service to you.

You are responsible for maintaining your own backups of Your Data. While we take reasonable measures to protect and preserve Your Data, we are not liable for any loss or corruption of data.

5. AI-Generated Content

The Service uses artificial intelligence to generate maintenance schedules based on your boat configuration. AI-generated maintenance schedules are provided as informational guidance only. You acknowledge that:

  • AI-generated schedules may not be perfectly accurate for your specific vessel
  • You should always consult your engine and equipment manufacturer's official maintenance manuals
  • HullKeeper is not a substitute for professional marine mechanical advice
  • You are solely responsible for maintaining your vessel in safe operating condition

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious content, viruses, or harmful code
  • Use automated means to access the Service without our written permission
  • Impersonate another person or misrepresent your affiliation

7. Intellectual Property

The Service, including its design, features, code, and content (excluding Your Data), is owned by HullKeeper and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. MAINTENANCE SCHEDULES AND RECOMMENDATIONS PROVIDED BY THE SERVICE ARE FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS A SOLE SOURCE OF MAINTENANCE GUIDANCE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HULLKEEPER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless HullKeeper from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
